Kerala High Court

Kerala Government is in the news for all the bad reasons over the alleged deal with a US-based cloud data service provider Sprinklr. The Kerala High Court has slammed the State Government over the Sprinklr deal. A division bench comprising of Justice Devan Ramachandran and TR Ravi of the Kerala High Court asked the Government to reply back if the privacy of data was ensured in the contract.

The State Government had pleaded that the services of the company have been sought for data analysis. The court asked whether the Government is incapable of handling data of 2 lakh people. The High Court also asked whether there is an IT department functioning in the state.

The court posted several questions before the state Government

  • Why the Sprinklr deal was not forwarded to the Law Department?
  • Why Kerala entered not the deal with jurisdiction in New York?
  • Why cloud platform was used to store patient data even after the decline in the COVID-19 and quarantine cases?

The court has given time before April 24 to file a response when the court files up with hearing. The petition was filed by Balu Gopalakrishnan alleging foul play and conspiracy in the LDF Government decision. The handing over of sensitive patient information to a US-based private company is a matter of concern.

When the additional advocate general KK Ravindranath made a statement that data collected is not sensitive. However, the court quickly responded that they are unable to believe that the collected data is not sensitive. Justice Devan added that health data in any format is sensitive. The petitioner added that data is curated and handed over to a third-party company, which will fetch millions of dollars. Moreover, the Kerala Government can’t escape from the whole episode.

The whole decision to implement Sprinklr’s software system is being taken by IT Secretary M Shivshankar. He recently appeared on Television channels and revealed that he hasn’t taken approval from the Law Department because there is no financial involvement. The court wondered whether a high capacity Amazon cloud server is required to host all the information. The Government contended that data is currently stored on Amazon’s cloud server owned by CDIT with an approximate cost of Rs 1.25 crore.

The court also expressed surprise with the legal jurisdiction of the deal is in New York. What will happen if something happens to the data? Will the State Government appear for a case files in New York?
